Government Public Relations Video Content Terms of Use

(Purpose)

Article 1: This Terms of Use (hereinafter referred to as the "Agreement") is intended to establish procedures for lending and the terms of use, as well as other necessary matters related to government public relations video content (hereinafter referred to as "Government PR Videos") held by the Government Public Relations Office, Minister’s Secretariat, Cabinet Office, (hereinafter referred to as the "Government PR Office").

(Definitions)

Article 2: In this Agreement, the meanings of the terms listed in the following items shall be as defined in each respective item:

  1. (ⅰ)"Applicant" refers to the individual who applies for the lending of Government PR Videos.
  2. (ⅱ)"User" refers to the individual who has received permission for lending from the Government PR Office and uses Government PR Videos.
  3. (ⅲ)"Organized Crime Group Member, etc." refers to organized crime group (referred to as "organized crime group" as defined in Article 2, item (ii) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Law No. 77 of 1991)) and organized crime group members (referred to as "organized crime group members" as defined in Article 2, item (vi) of the same Act).
  4. (ⅳ)"Lending" refers to the lending of Government PR Videos through recorded media such as DVDs or providing video files via the internet.
  5. (ⅴ)"Government Public Relations Website" refers to the website operated by the Government PR Office in addition to the Government Public Relations Online (https://www.gov-online.go.jp/).

(Application for Lending)

Article 3:(1) Applicants shall follow the procedures specified by the Government PR Office and apply for lending by clearly stating the purpose of use, the method of use, the lending period, and other information requested by the Government PR Office on the Government Public Relations website.

(2) In the case of an application based on the preceding paragraph, the Government PR Office will determine whether to approve the application and notify the applicant of the result. The Government PR Office is not obligated to disclose the reasons for not granting approval, even if lending is not permitted.

(Permission for Lending)

Article 4:(1) Lending of Government PR Videos shall be carried out only when approved by the Government PR Office.

(2) The Government PR Office shall not grant permission for lending in the following cases:

    1. (ⅰ)When used for purposes other than non-profit and public interest.
    2. (ⅱ)When used with the purpose or method that harms the honor or reputation of the author.
    3. (ⅲ)When used for criminal activities or other activities contrary to public order and morals.
    4. (ⅳ)When used for purposes or methods that significantly lack social acceptability.
    5. (ⅴ)When the applicant or user is an organized crime group member, etc.
    6. (ⅵ)In other cases where the Government PR Office deems it inappropriate to grant permission in light of the purpose of government public relations, in addition to the cases listed in the preceding items.

(3) Users must provide the source when using Government PR Videos.

(Notification)

Article 5:(1) If there are errors in the information provided to the Government PR Office by the applicant or if there are changes, the applicant must immediately notify the Government PR Office.

(2) Notifications from the Government PR Office to the applicant shall be made to the email address provided by the user, and notification shall be deemed complete when the Government PR Office sends the email to the provided email address.

(Ownership of Rights)

Article 6:(1) Copyrights and other intellectual property rights, rights of portrait of individuals who are subjects, publicity rights, privacy rights, and other moral rights related to Government PR Videos belong to the Government PR Office or third parties holding such rights and are not transferred to the user.

(2) Users have the right to use Government PR Videos only for the approved purposes and methods specified during lending.

(Prohibited Acts)

Article 7: Users are prohibited from engaging in any of the following items without the permission of the Government PR Office:

  1. (ⅰ)Lending or transferring Government PR Videos, in whole or in part, to third parties.
  2. (ⅱ)Using Government PR Videos, in whole or in part, through duplication, translation, transformation, or adaptation, etc.
  3. (ⅲ)Posting Government PR Videos, in whole or in part, on websites or video distribution sites, or making them publicly available on social networking sites (SNS), or engaging in other public transmissions.
  4. (ⅳ)Using Government PR Videos, in whole or in part, for purposes other than those permitted by the Government PR Office.
  5. (ⅴ)Using Government PR Videos, in whole or in part, beyond the lending period permitted by the Government PR Office.

(Suspension of Lending, etc.)

Article 8:(1) If the Government PR Office determines that a user has violated or is likely to violate the provisions of the preceding article, the Government PR Office may suspend or interrupt lending and may take necessary measures, including the deletion of Government PR Videos (including changes or additions to the terms of use. The same applies to the following paragraph), and users shall comply with such measures.

(2) In the event of unavoidable circumstances, such as changes in government policies, the Government PR Office may suspend or interrupt lending and may take necessary measures regarding Government PR Videos, and users shall comply with such measures.

(3) The Government PR Office shall not be liable for any damages arising from the suspension or interruption of use in accordance with the provisions of the preceding two paragraphs.

(Damage Compensation)

Article 9: Users shall compensate for all damages caused to the Government PR Office or third parties due to the use of Government PR Videos by the user.

(Measures after the End of the Lending Period)

Article 10: When the lending period of Government PR Videos has ended (including cases where the Government PR Office has notified the suspension of lending), users shall promptly return the recorded media of the lent Government PR Videos or delete video files provided, using means that cannot be restored. If users have created duplicates, they shall also return or delete the duplicates in the same manner.

(Burden of Costs)

Article 11:(1) The use of Government PR Videos is free of charge.

(2) All costs related to lending, use, and the return or deletion of Government PR Videos shall be borne by the user.

(Disclaimer, etc.)

Article 12:(1) The Government PR Office shall not be liable for any damages incurred by users in connection with the lending and use of Government PR Videos, except in cases where the Government PR Office has intentional or gross negligence.

(2) The Government PR Office does not guarantee the accuracy, completeness, timeliness of the content of Government PR Videos, and their suitability for the specific purposes of users and the legality of users' methods of use.

(3) Users shall consider whether separate consent is required from third parties based on their own purposes or methods of use when using Government PR Videos and, if necessary, obtain consent from third parties at their own expense and responsibility.

(Confidentiality)

Article 13: Users shall not disclose to third parties information that has been clearly disclosed as confidential by the Government PR Office or information that should be kept confidential due to its nature when using Government PR Videos without the permission of the Government PR Office and shall manage it to prevent leakage.

(Handling of Personal Information)

Article 14: The Government PR Office shall handle personal information obtained from applicants in accordance with a separately provided privacy policy.

(Prohibition of Assignment of Rights and Obligations)

Article 15: Users shall not assign, transfer, pledge, or otherwise dispose of their status as users, rights held as users, or obligations as users under Agreement to any third party.

(Amendment of this Agreement)

Article 16: (1)The Government PR Office may amend this Agreement.

(2) If users receive Government PR Videos after the amendment of this Agreement, they shall be deemed to have agreed to the amended terms of use.

(3) The Government PR Office shall not be liable for any damages or disputes arising from the amendment of the preceding paragraph.

(Applicable Law and Jurisdiction by Agreement)

Article 17: This Agreement shall be interpreted in accordance with Japanese law. All disputes related to the use of Government PR Videos based on this Agreement and all disputes related to this Agreement shall be exclusively subject to the jurisdiction of the Tokyo District Court as the first-instance exclusive agreement jurisdiction court.
